概要
本利用規約（以下「本規約」といいます）は、アイキューブ合同会社（以下「当社」といいます）が運営するオンラインストア「PRINTTERRA」（以下「本ストア」といいます）およびこれに関連するウェブサイト、コンテンツ、機能、ツール、商品、注文その他のサービス（総称して「本サービス」といいます）の利用条件を定めるものです。
本サービスはShopifyのECプラットフォームを利用して提供されています。
本サービスを訪問、閲覧、利用し、または商品を購入することにより、お客様は本規約ならびに当社のプライバシーポリシー、返品・返金ポリシー、配送ポリシーその他本サービス上に掲載されるポリシーに同意したものとみなされます。
本規約に同意いただけない場合は、本サービスをご利用いただくことはできません。
セクション1 - アクセスおよびアカウント
お客様は、本サービスを利用するにあたり、適用される法令上ご自身で有効な契約を締結できる年齢に達していること、または必要に応じて親権者その他の法定代理人の同意を得ていることを表明するものとします。
本サービスの利用、商品の購入、アカウントの作成等に際して、氏名、メールアドレス、請求先情報、決済情報、配送先情報その他必要な情報の提供をお願いする場合があります。
お客様は、当社に提供する情報が正確、最新かつ完全なものであり、その情報を提供する正当な権限を有することを保証するものとします。
アカウントを作成した場合、お客様はログイン情報およびパスワード等を適切に管理し、第三者による不正利用を防止する責任を負います。
お客様は、当社の事前の承諾なく、ご自身のアカウントを第三者に譲渡、販売、貸与その他の方法で利用させることはできません。
セクション2 - 当社の商品
当社は、本ストアに掲載する商品の画像、説明、寸法、色、素材その他の情報をできる限り正確に表示するよう努めます。
ただし、お客様が使用するディスプレイ、端末、ブラウザその他の環境により、実際の商品と画面上の色、質感、外観等が異なって見える場合があります。
3Dプリント製品について
PRINTTERRAの商品には、3Dプリント技術によって製造された製品が含まれます。
製造方法の特性上、以下のような個体差が生じる場合があります。
- 積層痕
- 微細な表面の凹凸
- 継ぎ目
- サポート材除去跡
- 微細な糸引きまたは加工跡
- 色味や質感の軽微な差
- 寸法上のわずかな個体差
これらが商品説明および通常の製造品質の範囲内であり、商品の機能または通常使用に支障をきたさない場合は、3Dプリント製法に由来する正常な特性として取り扱います。
商品の仕様、価格、デザイン、カラー、販売数量その他の商品情報は、法令上認められる範囲で予告なく変更される場合があります。
当社は、特定の商品について販売数量、販売地域または購入数量を制限し、または販売を終了する場合があります。
セクション3 - 注文
お客様が本ストアを通じて注文を送信した場合、それは当社に対する商品の購入申込みとなります。
当社は、在庫不足、決済上の問題、商品情報または価格の明らかな誤り、不正利用の疑い、配送上の制約その他合理的な理由がある場合、注文を承諾しない、変更する、またはキャンセルする場合があります。
注文の変更またはキャンセルが必要となった場合、当社は注文時に提供されたメールアドレス、電話番号その他の連絡先を使用してお客様への連絡を試みます。
ご注文確定前に、商品、数量、カラー、サイズ、配送先その他の注文内容を十分にご確認ください。
注文後のキャンセルについては、商品の製造状況または発送準備状況によって対応できない場合があります。
返品、交換および返金については、当社の返品・返金ポリシーが適用されます。
原則として、本ストアで購入された商品は、お客様ご自身またはご家庭での利用を目的としています。当社の事前の承諾なく、商業的な転売を主目的として購入することはできません。
セクション4 - 価格および支払い
商品の販売価格は、商品ページまたはチェックアウト画面に表示されます。
価格、割引、キャンペーンおよびプロモーションは、法令上認められる範囲で予告なく変更される場合があります。
商品に適用される価格は、原則として注文時に本ストアに表示された価格となります。
送料、銀行振込手数料、関税、輸入税その他商品代金以外の費用が発生する場合があります。
実際にお客様がお支払いいただく金額は、原則としてご注文確定前のチェックアウト画面に表示されます。
お客様は、購入にあたり正確かつ完全な請求情報、決済情報および連絡先情報を提供するものとします。
クレジットカードを使用する場合、お客様は当該カードを使用する正当な権限を有するものとします。
銀行振込をご利用の場合、当社が指定する期限までにお支払いください。期限までにご入金を確認できない場合、注文をキャンセルする場合があります。
セクション5 - 発送および配達
商品の発送および配送については、当社の配送ポリシーが適用されます。
本ストア上に表示される発送予定日および配送予定日は目安であり、特に明示されている場合を除き、到着日を保証するものではありません。
天候、自然災害、交通事情、配送事業者、通関手続、繁忙期その他当社の合理的な管理を超える事情により、商品の発送または配送が遅延する場合があります。
当社は、適用される法令上認められる範囲において、当社の合理的な管理を超える事情による配送遅延について責任を負わないものとします。
配送中の商品に破損、紛失その他の問題が生じた場合は、配送ポリシーおよび返品・返金ポリシーに従って対応します。
セクション6 - 知的財産権
本サービスに含まれる文章、画像、写真、動画、音声、ロゴ、ブランド、商品名、商品デザイン、グラフィックス、3Dモデル、3Dデータ、レイアウトその他のコンテンツに関する著作権、商標権、意匠権その他の知的財産権は、当社または正当な権利者に帰属します。
法令により認められる場合を除き、当社の事前の書面による許可なく、これらを複製、転載、配布、改変、販売、公衆送信、二次利用その他の方法で利用することはできません。
「PRINTTERRA」の名称、ロゴ、商品名、商品デザイン等に関する権利は、当社または正当な権利者に帰属します。
Shopifyの名称、ロゴその他の商標は、Shopifyまたはその権利者に帰属します。
セクション7 - オプションツール
本サービスでは、第三者が提供するツール、アプリ、機能その他のサービスを利用できる場合があります。
これらの第三者サービスについては、それぞれのサービス提供者が定める利用条件およびプライバシーポリシー等が適用される場合があります。
当社は、当社が管理していない第三者サービスの内容、正確性、安全性または利用可能性を保証するものではありません。
お客様は、第三者サービスの利用条件を確認したうえで、ご自身の判断と責任において利用するものとします。
今後本サービスに追加される新しい機能、ツールおよびサービスについても、別途定めがない限り本規約が適用されます。
セクション8 - 外部サービスへのリンク
本サービスには、第三者が運営するウェブサイトまたはサービスへのリンクが含まれる場合があります。
当社は、当社が管理していない外部ウェブサイトについて、その内容、正確性、安全性、商品、サービスまたは取引について保証するものではありません。
外部サービスを利用する場合は、当該サービスの利用規約、プライバシーポリシーその他の条件をご確認ください。
外部サービスの商品またはサービスに関する問い合わせ、苦情、請求等については、原則として当該サービス提供者へ直接お問い合わせください。
セクション9 - Shopifyとの関係
PRINTTERRAはShopifyのプラットフォームを利用して本サービスを提供しています。
ただし、本ストアにおける商品の販売およびお客様との売買契約は、PRINTTERRAを運営するアイキューブ合同会社とお客様との間で直接行われるものです。
Shopifyは、当社とお客様との間の商品の販売、購入、配送、商品の品質その他の取引そのものの売主ではありません。
適用される法令上認められる範囲において、当社とお客様との間の購入または取引に起因する請求について、Shopifyおよびその関連会社は責任を負いません。
セクション10 - プライバシーポリシー
本サービスを通じて取り扱われる個人情報については、当社のプライバシーポリシーが適用されます。
本サービスはShopifyによってホストされているため、Shopifyは、本サービスの提供、安全性の確保および改善等を目的として、お客様による本サービスへのアクセスおよび利用に関連する個人情報を収集・処理する場合があります。
また、お客様が本サービスを通じて提供した情報は、本サービスを提供するため、Shopifyその他のサービス事業者に送信または共有される場合があります。
Shopifyによる個人情報の取扱いについては、Shopifyが提供するプライバシー情報もご確認ください。
セクション11 - フィードバック
お客様が当社に対して、レビュー、アイデア、提案、コメント、画像その他のフィードバック（以下「フィードバック」といいます）を提供した場合、お客様は、適用される法令上認められる範囲で、当社が本サービスおよび商品の運営、改善、宣伝等のために当該フィードバックを利用、複製、編集、公開または表示することを許諾するものとします。
お客様は、ご自身が提供するフィードバックについて必要な権利を有し、第三者の著作権、商標権、プライバシー、名誉その他の権利を侵害しないことを保証するものとします。
フィードバックには、違法、中傷的、脅迫的、差別的、わいせつその他不適切な内容、またはコンピューターウイルスその他の有害なコードを含めることはできません。
当社は、必要と判断した場合、フィードバックを削除または編集することがあります。
セクション12 - 誤り、不正確な情報および記載漏れ
本サービス上の商品説明、価格、プロモーション、送料、在庫状況、配送予定その他の情報に、誤記、不正確な情報または記載漏れが生じる場合があります。
当社は、これらを発見した場合、法令上認められる範囲で修正または更新することがあります。
価格その他の情報に明らかな誤りがあり、合理的にその誤りが認識できる場合、当社はお客様へ連絡のうえ注文内容の修正またはキャンセルをお願いする場合があります。
セクション13 - 禁止事項
お客様は、本サービスを合法的な目的にのみ利用するものとします。
以下の行為を禁止します。
- 法令または公序良俗に違反する行為
- 犯罪または不正行為を目的とする利用
- 当社または第三者の知的財産権その他の権利を侵害する行為
- 他人への嫌がらせ、脅迫、誹謗中傷その他の権利侵害
- 虚偽または誤解を招く情報を送信する行為
- 他人になりすます行為
- ウイルス、マルウェアその他有害なコードを送信する行為
- スパム、フィッシングその他不正な勧誘行為
- 本サービスまたは関連システムへの不正アクセス
- セキュリティ機能を妨害または回避する行為
- 当社の許可なく本サービスの内容をスクレイピング、大量取得または再利用する行為
- 当社または他のお客様による本サービスの利用を妨げる行為
- その他当社が合理的に不適切と判断する行為
当社は、本規約に重大な違反があると合理的に判断した場合、本サービスまたはアカウントへのアクセスを制限、停止または終了する場合があります。
セクション14 - 自動化されたエージェント
本条は、AIエージェントその他の自律的または半自律的なソフトウェア（以下「エージェント」といいます）を使用して本サービスにアクセス、利用または操作する場合に適用されます。
エージェントは、自らが自動化されたシステムであることを隠蔽してはならず、当社がエージェントによるアクセスを制限または禁止する場合は、その制限に従う必要があります。
エージェントは、人間による操作を装い、CAPTCHAその他人間と自動システムを区別するための技術的措置を回避してはなりません。
また、当社が技術的またはその他の手段によってエージェントによるアクセスを制御する場合、当該措置を回避してはなりません。
当社が技術的に要求する場合、エージェントはHTTP/HTTPSリクエスト等において、自身がエージェントであることおよびエージェント名を適切に識別できる情報を提供するものとします。
セクション15 - 利用停止および終了
当社は、お客様が本規約に違反した場合、不正利用が疑われる場合、本サービスの安全性または運営に支障を与える場合その他合理的な理由がある場合、本サービスへのアクセスまたはアカウントを停止または終了する場合があります。
サービスの利用が終了した場合でも、終了時点までに発生した支払義務その他の義務は引き続き有効です。
知的財産権、フィードバック、責任の制限、準拠法その他その性質上終了後も存続すべき条項は、サービス終了後も有効に存続します。
セクション16 - 保証に関する事項
当社は、本サービスの運営にあたり合理的な注意を払いますが、本サービスが常に中断なく、完全に安全で、エラーなく提供されることを保証するものではありません。
本サービス上の一般的な情報について、当社は可能な限り正確な情報を提供するよう努めますが、その完全性、正確性または特定の目的への適合性を保証するものではありません。
ただし、本条その他本規約のいかなる規定も、消費者契約法その他の適用される強行法規に基づき当社が負う責任を免除または制限するものではありません。
セクション17 - 責任の制限
当社の責任は、適用される法令により認められる範囲で制限されます。
当社の故意または重大な過失による場合、または法令上責任を制限することが認められない場合を除き、当社は、本サービスまたは商品の利用に関連して発生した間接損害、特別損害、付随的損害、逸失利益その他通常かつ直接の損害を超える損害について責任を負わないものとします。
当社の軽過失によりお客様に損害が生じた場合、適用される法令により認められる範囲で、当社が負う責任は、当該損害の原因となった取引についてお客様が実際に当社へ支払った金額を上限とします。
ただし、消費者契約法その他の強行法規によりこのような責任制限が認められない場合は、その法令が優先されます。
セクション18 - お客様の責任
お客様が故意または過失により本規約に違反し、または第三者の権利を侵害したことにより、当社または第三者に損害が発生した場合、お客様は法令上認められる範囲でその損害について責任を負うものとします。
セクション19 - 分離可能性
本規約の一部が法令または裁判所等により無効または執行不能と判断された場合でも、その部分を除くその他の規定は、引き続き有効に存続します。
セクション20 - 権利放棄および完全合意
当社が本規約上の権利を直ちに行使しなかった場合でも、その権利を放棄したものとはみなされません。
本規約ならびに本サービス上に掲載する返品・返金ポリシー、プライバシーポリシー、配送ポリシーその他のポリシーは、本サービスの利用および商品の購入に関する当社とお客様との合意を構成します。
セクション21 - 権利義務の譲渡
お客様は、当社の事前の書面による承諾なく、本規約上の地位または権利義務を第三者へ譲渡することはできません。
当社は、合併、会社分割、事業譲渡その他の事業承継に伴い、本規約上の地位または権利義務を第三者へ承継させる場合があります。
セクション22 - 準拠法および管轄
本規約、本サービスおよび当社とお客様との間の売買契約には、法令に別段の定めがある場合を除き、日本法を適用します。
本サービスまたは本規約に関連して当社とお客様との間で紛争が生じた場合には、法令上認められる範囲で、当社の本店所在地を管轄する日本の裁判所を第一審の合意管轄裁判所とします。
お客様の居住地に適用される強行的な消費者保護法令が別途管轄その他の権利を認める場合、その権利を妨げるものではありません。

本規約に使用される見出しは、便宜上設けられたものであり、各条項の意味または範囲を制限するものではありません。
セクション24 - 利用規約の変更
当社は、法令の改正、本サービスの内容変更、Shopifyその他の利用サービスの変更、事業上の必要その他合理的な理由がある場合、本規約を変更することがあります。
重要な変更がある場合は、適用される法令に従い、本ストアへの掲載、メールその他適切な方法によりお知らせします。
変更後の利用規約は、別途定めがない限り、本ストアに掲載された時点または通知された発効日から適用されます。

Overview
These Terms of Service ("Terms") govern your access to and use of the PRINTTERRA online store operated by icube LLC ("we," "us," or "our"), including our website, content, features, tools, products, ordering services, and related services (collectively, the "Services").
The Services are provided using Shopify's ecommerce platform.
By visiting, browsing, using the Services, or purchasing products from us, you agree to these Terms and to our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies made available through the Services.
If you do not agree to these Terms, you may not use the Services.
Section 1 - Access and Accounts
By using the Services, you represent that you are legally capable of entering into a binding agreement under applicable law or, where required, that you have obtained the consent of a parent or legal guardian.
To use certain features of the Services or purchase products, you may be required to provide information such as your name, email address, billing information, payment information, and shipping information.
You agree that all information you provide is accurate, current, and complete and that you have the necessary authority to provide such information.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials.
You may not transfer, sell, assign, lend, or otherwise permit another person to use your account without our prior consent.
Section 2 - Our Products
We make reasonable efforts to display product descriptions, images, dimensions, colors, materials, and other information as accurately as possible.
However, actual colors, textures, and appearance may vary from what you see on your screen depending on your device, display, browser, and other settings.
3D-Printed Products
Some PRINTTERRA products are manufactured using 3D-printing technology.
Due to the nature of this manufacturing process, products may exhibit characteristics including:
- Visible layer lines
- Minor surface irregularities
- Seams
- Support-removal marks
- Minor stringing or manufacturing marks
- Slight variations in color or texture
- Minor dimensional variations
Where these characteristics fall within the normal manufacturing standards described on the applicable product page and do not interfere with the normal function or use of the product, they will be treated as normal characteristics of the 3D-printing process.
Product specifications, prices, designs, colors, availability, and other product information may be changed where permitted by applicable law.
We may limit quantities, geographic availability, or purchases of particular products and may discontinue products.
Section 3 - Orders
Submitting an order through our store constitutes an offer to purchase products from us.
We may decline, modify, or cancel an order where reasonably necessary, including due to insufficient inventory, payment problems, obvious errors in pricing or product information, suspected fraud, shipping restrictions, or other reasonable circumstances.
If we need to change or cancel an order, we may attempt to contact you using the email address, telephone number, or other contact details provided with your order.
Please carefully review all product, quantity, color, size, shipping, and other order information before placing your order.
We may not be able to accommodate cancellation requests after production or preparation for shipment has begun.
Returns, exchanges, and refunds are governed by our Return & Refund Policy.
Products sold through our store are generally intended for personal or household use and may not be purchased primarily for commercial resale without our prior consent.
Section 4 - Prices and Payment
Product prices are displayed on the relevant product page or at checkout.
Prices, discounts, campaigns, and promotions may change without prior notice where permitted by law.
The price applicable to an order will generally be the price displayed when the order is placed.
Additional charges may apply, including shipping fees, bank transfer fees, customs duties, import taxes, and other charges.
The total amount payable will generally be displayed at checkout before your order is completed.
You agree to provide current, complete, and accurate billing, payment, and contact information.
If you use a credit card, you represent that you are authorized to use that card.
For bank transfers, payment must be completed by the deadline specified by us. We may cancel an order if payment is not confirmed by that deadline.
Section 5 - Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy.
Shipping and delivery estimates are provided for reference only and are not guaranteed unless expressly stated otherwise.
Shipments may be delayed due to weather, natural disasters, traffic conditions, carriers, customs procedures, peak shipping periods, or other circumstances beyond our reasonable control.
To the extent permitted by applicable law, we are not responsible for delays caused by circumstances beyond our reasonable control.
Damage, loss, or other issues occurring during delivery will be handled in accordance with our Shipping Policy and Return & Refund Policy.
Section 6 - Intellectual Property
All text, photographs, images, video, audio, logos, branding, product names, product designs, graphics, 3D models, 3D data, layouts, and other content contained in the Services are owned by us or their respective lawful owners and are protected by applicable intellectual property laws.
Except as permitted by applicable law, you may not copy, reproduce, distribute, modify, sell, publicly transmit, republish, or otherwise use such content without prior written permission.
The PRINTTERRA name, logos, product names, and product designs are owned by us or their respective lawful owners.
The Shopify name, logo, and other trademarks belong to Shopify or their respective owners.
Section 7 - Optional Tools
The Services may provide access to tools, applications, features, or other services provided by third parties.
Third-party terms of use, privacy policies, and other conditions may apply to such services.
We do not warrant the content, accuracy, security, or availability of third-party services that we do not control.
You use such services at your own discretion and should review the applicable provider's terms before using them.
Any new features, tools, or services added to the Services will also be subject to these Terms unless otherwise stated.
Section 8 - Third-Party Links
The Services may contain links to websites or services operated by third parties.
We do not warrant or assume responsibility for the content, accuracy, security, products, services, or transactions of websites that we do not control.
Please review the applicable terms, privacy policies, and practices before using any third-party service.
Questions or claims concerning third-party products or services should generally be directed to the applicable third-party provider.
Section 9 - Relationship with Shopify
PRINTTERRA uses Shopify's platform to provide the Services.
However, sales and purchase agreements made through our store are entered into directly between the customer and icube LLC, the operator of PRINTTERRA.
Shopify is not the seller of the products offered through our store and is not a party to the underlying sale, delivery, or product transaction between you and us.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims arising from purchases or transactions between you and us.
Section 10 - Privacy Policy
Personal information processed through the Services is governed by our Privacy Policy.
Because the Services are hosted through Shopify, Shopify may collect and process personal information relating to your access to and use of the Services for purposes including providing, securing, and improving its services.
Information submitted through the Services may also be transmitted to or shared with Shopify and other service providers where necessary to provide the Services.
Please also review Shopify's applicable privacy information for further information regarding Shopify's processing activities.
Section 11 - Feedback
If you provide reviews, ideas, suggestions, comments, images, or other feedback ("Feedback"), you grant us permission, to the extent permitted by applicable law, to use, reproduce, edit, publish, and display such Feedback for purposes including operating, improving, and promoting our Services and products.
You represent that you have all necessary rights to submit the Feedback and that the Feedback does not infringe any third party's intellectual property, privacy, reputation, or other rights.
Feedback must not contain unlawful, defamatory, threatening, discriminatory, obscene, or otherwise inappropriate material, computer viruses, or other harmful code.
We may remove or edit Feedback where reasonably necessary.
Section 12 - Errors, Inaccuracies, and Omissions
Information contained in the Services, including product descriptions, prices, promotions, shipping fees, availability, and delivery estimates, may occasionally contain typographical errors, inaccuracies, or omissions.
We may correct or update such information where permitted by applicable law.
If there is an obvious error in pricing or other information that could reasonably be recognized as an error, we may contact you to request correction or cancellation of the affected order.
Section 13 - Prohibited Uses
You may use the Services only for lawful purposes.
You may not:
- Violate applicable laws or public policy
- Use the Services for unlawful or fraudulent purposes
- Infringe our intellectual property rights or those of any third party
- Harass, threaten, defame, or otherwise harm another person
- Submit false or misleading information
- Impersonate another person or entity
- Upload viruses, malware, or other harmful code
- Engage in spam, phishing, or fraudulent solicitation
- Obtain unauthorized access to the Services or related systems
- Interfere with or circumvent security features
- Scrape, systematically extract, or reuse content without authorization
- Interfere with another person's use of the Services
- Engage in other conduct that we reasonably determine to be inappropriate
Where we reasonably believe that a material breach of these Terms has occurred, we may restrict, suspend, or terminate access to the Services or an account.
Section 14 - Automated Agents
This Section applies where artificial intelligence agents or other autonomous or semi-autonomous software ("Agents") are used to access, use, or interact with the Services.
Agents must not conceal the fact that they are automated systems and must comply with any restrictions we impose on automated access.
Agents may not imitate human behavior for the purpose of concealing their automated nature or circumvent CAPTCHA or other technologies designed to distinguish humans from automated systems.
Agents must not circumvent technical or other measures used by us to control automated access.
Where technically required by us, an Agent must provide appropriate information in HTTP/HTTPS requests or otherwise to identify itself as an Agent and identify the Agent by name.
Section 15 - Suspension and Termination
We may suspend or terminate access to the Services or an account where you breach these Terms, where fraudulent activity is suspected, where use threatens the security or operation of the Services, or for another reasonable reason.
Termination does not affect obligations, including payment obligations, that arose before termination.
Provisions concerning intellectual property, Feedback, limitations of liability, governing law, and other provisions that by their nature should survive termination will remain effective after termination.
Section 16 - Disclaimer of Warranties
We exercise reasonable care in operating the Services but do not guarantee that the Services will always be uninterrupted, completely secure, or error-free.
We make reasonable efforts to provide accurate general information through the Services but do not guarantee that all such information will always be complete, accurate, or suitable for every particular purpose.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable mandatory law, including applicable consumer protection laws.
Section 17 - Limitation of Liability
Our liability is limited to the extent permitted by applicable law.
Except in cases of our intentional misconduct or gross negligence, or where liability cannot legally be limited, we will not be liable for indirect, special, incidental, consequential, or lost-profit damages arising from or related to the Services or products.
Where damage is caused by our ordinary negligence, our liability may, to the extent permitted by applicable law, be limited to direct and ordinary damages up to the amount actually paid by you for the transaction giving rise to the claim.
